Ticketing Terms and Conditions

Effective as of July 1, 2025

I. General Ticket Use

  • All tickets issued by Theatre Under The Stars (“TUTS”) constitute revocable licenses, which may be revoked at any time, with or without cause, at the sole and absolute discretion of TUTS, including but not limited to instances of misconduct, fraud, policy violations, or failure to comply with applicable terms and conditions.
  • Upon issuance or delivery, all risk of loss, theft, or destruction of tickets shall pass to the ticket holder, and TUTS shall bear no liability thereafter.
  • Admission to any event shall be granted solely upon presentation of a valid ticket corresponding to the designated event, date, time, and seat location.

II. Payment, Refunds, and Cancellations

  • All ticket sales are deemed final and non-refundable. Cancellations, exchanges, or modifications are not permitted except as explicitly stated herein or otherwise authorized in writing by TUTS.
  • In the event that a scheduled performance is cancelled and not rescheduled, TUTS, in its sole discretion, may offer one or more of the following remedies: (i) a pro-rated refund of the face value of the ticket; (ii) credit toward a future ticket purchase; or (iii) the option to donate the ticket value to a designated charitable organization.
  • Ticket holders who have obtained event insurance may be eligible for exchange per the terms of the applicable insurance policy.
  • Any attempt to obtain a refund, exchange, or credit by circumventing these terms, including but not limited to initiating a chargeback with a financial institution, shall constitute a breach of these terms and may result in cancellation of tickets and suspension of future purchasing privileges.

III. Ticket Delivery and Will Call

  • TUTS reserves the right to delay the issuance of tickets or mobile barcodes until such time as it deems appropriate, including as a measure to prevent fraudulent activity.
  • Physical tickets may be held at Will Call and shall be released only upon presentation of valid government-issued identification and, if applicable, the original form of payment.
  • No delivery will be made to P.O. boxes via third-party courier. A signature may be required upon delivery when applicable.

IV. Attendance by Minors and Content Suitability

  • Each individual attending a performance, regardless of age, including infants and children, must possess a valid ticket.
  • Children under the age of six (6) are discouraged from attending performances that are not expressly marketed as family-friendly.
  • Infants shall not be permitted to attend Broadway or comparable performances. No refunds shall be granted on the basis of content deemed inappropriate or offensive by the ticket holder.

V. Exchanges and Seating Allocation

  • All seating assignments are determined at the sole discretion of TUTS and are subject to change due to production needs, safety protocols, or other operational considerations.
  • TUTS reserves the right to reassign comparable seating without notice. Such reassignment shall not constitute grounds for refund or cancellation.
  • Exchanges are permitted only for holders of valid ticket insurance or at the sole discretion of TUTS.

VI. Group Sales and Ticket Limits

  • Unless otherwise specified, a maximum of nine (9) tickets may be purchased per household, per production.
  • Group Sales transactions typically apply to purchases of ten (10) or more tickets. Group benefits are not guaranteed until payment is received in full and written confirmation is provided by TUTS.
  • TUTS reserves the right to revoke group privileges, including but not limited to discounts, if it is determined that any tickets have been resold for profit in contravention of these terms.

VII. Resale and Anti-Scalping Provisions

  • Tickets may not be resold, offered, or transferred for commercial purposes without the express written consent of TUTS.
  • Tickets obtained through unauthorized resale or in violation of these terms may be voided without compensation and subject the original purchaser to forfeiture of future purchasing privileges.
  • TUTS employs electronic monitoring systems to detect unauthorized resale or bulk purchasing patterns and reserves the right to take appropriate action, including cancellation of tickets and refusal of service.

VIII. Theater Conduct and Venue Rules

  • All patrons are expected to adhere to venue policies, which strictly prohibit smoking, vaping, photography, video recording, use of mobile devices during performances, and the possession of contraband including outside food, weapons, and illegal substances.
  • Latecomers may be admitted at the discretion of management and in accordance with production-specific guidelines. Refunds shall not be granted for denied or delayed seating.
  • Violations of conduct standards may result in immediate removal from the premises without refund and may further subject the violator to restrictions on future attendance.

IX. Accessibility and Public Health

  • TUTS provides accessible seating accommodations in compliance with applicable laws. Such seating is reserved exclusively for individuals with disabilities and their companions.
  • Attendance at a public performance constitutes acknowledgment of inherent risks associated with exposure to communicable diseases, including COVID-19. TUTS assumes no liability for illness or injury incurred in connection with attendance.
  • Compliance with all posted and communicated health and safety protocols is mandatory. Noncompliance may result in denied entry without recourse.

X. Communications and Customer Service

  • TUTS may use the contact information provided by the ticket holder to relay information regarding performance schedules, event changes, and promotional offers.
  • Recipients may opt out of marketing communications at any time in accordance with applicable law.

XI. Governing Law and Dispute Resolution

  • These terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.
  • Any disputes arising under or in connection with these terms shall be subject to binding arbitration in Harris County, Texas, pursuant to the rules of the American Arbitration Association.
  • Claims must be filed within one (1) year of the cause of action. No claims may be brought as part of a class action or representative proceeding.

XII. Modifications and Precedence

  • These terms are subject to modification at any time without prior notice. The most current version shall govern all ticket purchases and use.
  • In the event of a conflict between these terms and those contained in separate agreements or marketing materials, the terms of such agreements or materials shall prevail
